What are site rules?
Site rules for park home sites are often in place to reinforce good management of a site and to encourage communal cohesion.
Although it is not mandatory for a site to have site rules, they are intended to make sure that everyone living on the site is complying with a collective standard.
With site rules in place, disputes between residents can often be more easily remedied or avoided altogether. Site rules typically cover things like car parking arrangements, permissions to have pets, or the required age of residents on the site.
The site rules must be necessary to ensure that acceptable standards are maintained on the site for the general benefit of occupiers to promote community cohesion on the site.
A rule which requires consent from the site owner, except in relation to improvements to the property, is not permissible under the legislation. For example, the site owner cannot include a rule that says consent is needed before an occupier can park their car.
Certain rules that restrict selling or gifting of a park home are also not permissible. For example a site owner cannot include a rule which prevents the occupier from selling the property.
Site rules can only be changed or implemented by going through the site rules making process.
The procedure for site rules is in the Mobile Homes Act 2013 and the Mobile Homes (Site Rules) (England) Regulations 2014.
You can view the site rules for a particular park home site. The local authority retains a register which is open to members of the public during working hours. They may also be published online.
The site owner is not bound by the site rules that apply to other residents, even if the site owner lives on site. This is because the site owner doesn’t occupy the site under a Mobile Homes Act agreement. Their conduct will instead be regulated by the site licence issued by the local authority and any relevant legislation.
