Preparing your case

You’ll need to prepare evidence to support your tribunal case. What you’ll need will depend on what the case is about.

Tribunal directions

Ahead of your hearing, the tribunal will issue tribunal directions. These are instructions about the specific steps and strict deadlines you and the other party must follow to prepare your case, including when to submit evidence, when to send documents and whether there will be a site inspection.

You can ask the tribunal to instruct the site owner to provide relevant information to support your case.

The directions help everyone know what documents and witness evidence will be used. The tribunal might stop the case if you do not comply with them. The tribunal may also ignore new evidence if it is submitted too late.

If the site owner has applied to the tribunal, make sure you follow the directions and provide the information you’re asked for. If you do not provide evidence to support your case, the tribunal could make an automatic default decision against you.

Preparing documents

In most cases, you will need to prepare a bundle of the relevant documents and photos for the hearing or paper decision. The directions will say how many copies to send and the deadline, so the tribunal can review the case in advance.

The bundle must have an index at the front, and all pages must be numbered so everyone can find documents quickly at the hearing.

Group and multi-party actions

If a group action has been brought by a qualifying residents’ association, the group will need to appoint a lead representative to deal with applying to and communicating with the tribunal, as well as representing the group at the hearing.
